Infants & Preschoolers Must Get Flu Shot, NYC Judge States

The city’s Department of Health was validated by the Court of Appeals in its original decision to mandate flu shots during Mayor Bloomberg’s 2013 administration.
In 2015, a number of mothers in the city filed a lawsuit citing government overreach beyond the medical rights of parents.
“Promulgation of the flu vaccine falls squarely within the powers specifically delegated to the department,” the court stated in a unanimous decision.
Health Commissioner Dr. Mary Bassett said of the decision, this is a “great win for New York City children.”
“Children who receive the influenza vaccine are less likely to get sick, less likely to need medical attention and less likely to die from influenza,” she said. “This decision will help us protect more than 150,000 children in City-regulated daycares and preschools across the city.”
This is a huge blow to parents in the region looking to detach from a local government that seems adamant in abolishing as many rights for citizens as possible.
