Transgender Sues Catholic Hospital For Refusing Reassignment Surgery
The American Civil Liberties Union (ACLU) claims they have a case of transgender discrimination on their hands and they want the country to rally around them. The ACLU is now suing a catholic hospital, Dignity Health, for denying a transgender-related surgery. They were joined by the law firm Covington & Burling LLP.
The lawsuit was filed on behalf of Evan Minton, for which the ACLU claims “medical care” was denied. Minton is a transgender man who was slated to have a hysterectomy at Mercy San Juan Medical Center (this is one of Dignity Health’s wings). Two days prior to the surgery, a nurse called routinely to prepare Minton for the surgery. Minton, at this point, allegedly mentioned that this was part of his journey to transition genders. The following day, the hospital canceled the procedure.
“The refusal of Dignity Health to allow a doctor to perform this common procedure simply because the patient is transgender is discriminatory,” said Elizabeth Gill, a senior staff attorney at the ACLU of Northern California. “This is a hospital that is open to the general public so it’s illegal for them to turn away someone based on gender identity.”
Minton’s doctor also seems to be on record condemning the move.
“I routinely perform hysterectomies at Mercy San Juan,” said Dr. Lindsey Dawson, Minton’s doctor. “This is the first time the hospital has prevented me from doing this surgery. It’s very clear to me that the surgery was canceled because Evan is transgender.”
But here’s the rub, if you haven’t picked up on it already: the hospital is Catholic and acts under the Catholic doctrine. This goes for birth control just as well as it goes for a transgender reassignment surgery. And this surgery was not a medical necessity; in other words, the hospital wasn’t leaving Minton to die on the roadside because he’s a transgender.
Maybe there was confusion during the agreement to perform the surgery. Potentially, the hospital didn’t understand the original reasoning behind Minton’s surgery? Or Minton concealed it until he felt the hospital would feel obligated to carry it through?
Hysterectomies are performed in the hospital, just not as a part of gender reassignment. The hospital views Minton’s surgery as elective, not essential to his life.
Let’s dig further. Here’s a statement from the hospital.
“We understand how important this surgery is for transgender individuals, and were happy to provide Mr. Minton and his surgeon the use of another Dignity Health hospital for his surgery within a few days.”
So the hospital essentially helped Minton secure a new place to perform his surgery.
But according to the ACLU, Mr. Minton deserves some sort of monetary compensation for his inconvenience of waiting a few more days for an elective surgery that’s not life threatening. Minton did get his surgery from another hospital, and his doctor got emergency privileges there, again with the help of Dignity Health officials.
The ACLU has become a mafia group, strongarming anyone who doesn’t believe in their social justice mantras. The hospital did compromise their own beliefs by helping Minton and the surgeon carry on with the procedure. Minton got his surgery. But according to the ACLU, he deserves more.
There is virtually zero religious freedom left in this country. And hardly any strong organizations left to protect. Whether you are Catholic, Jewish or atheist, you should be concerned about the direction of our country.
